A guy in Denmark had a website where he made bootlegs free for download as mp3-files. Now a danish copyright-company has told him that he has to shut down the site or pay for the music, because it is a violation of copyright. Furthermore he claims that even if the guy gets Billy Corgan's permission, it will still be illegal. no. because a company that produce bootlegs is wrong as shit.In the dutch (holland) law stands: it is LEGAL to share, trade (copy or orginals) bootlegs, offer to download, or whatever. it is ILLEGAL to SELL ORGINAL OR COPY of any bootleg. that is the situation in Holland, so it has to be the same in Europe......... ------------------ touch me, i'm sick IP: Logged |

According to the legal advisor of KODA it's not legal to put up live music for download. He says it doesn't make a difference wether it's live or unreleased, it still breaks the copyright law. And it seems he's right. ------------------ plume - stuff IP: Logged |

This sounds really quite fishy to me. For one , when something is performed live royalties are never paid. This is why cover bands of .. abba for example make profit , as long as its only performed live they don't have to pay any royalties, yet if they put it to an album and then make PROFIT on it they have to pay. I Know that some websites won't allow you to post any media longer than a minute even if you own the copyrights to it, but you can't be sued . The only person who can sue you is the company that owns the music ( virgin ) or the pumpkins themselves. People that own the copyright only own the actual contract all money would have to be paid to virgin. I'd check who this money is supposed to be paid to and I'd talk to virgin ( or hut as its called as well I think) to find out. Personally I've never heard of someone being sued for posting unreleased music as unreleased music and live music is normally not bound to the record company therefor has no copyright on it. I mean there is a Ween website ( somewhere ) that constantly plays unreleased ween music with the artists permission. They have never had any problems .
